March 30, 2007 - The U.S. Department of Commerce (DoC) has issued a preliminary determination to apply U.S. countervailing duties (CVDs) on imports of glossy paper from China.
For two decades, the Commerce Department has exempted Chinese imports from the CVD law because of China’s classification as a non-market economy. However, with this decision, DoC acknowledged that the economic reforms that have taken place in China since the 1980s make it easier to measure the extent to which China subsidizes exports and to quantify the injury the subsidies cause.
DoC is scheduled to issue a final determination on this particular case in June. In the meantime, Congress is still pursuing legislation that would explicitly give Commerce the statutory authority to apply CVDs on Chinese imports, since Commerce until now has pursued a 20-year policy of not doing so.
